Priority right When filing a patent application (e.g. in Denmark), a priority right is established entitling the applicant to file a subsequent application for the same invention in other countries not later than 12 months after filing the original application. Consequently, the prior art which is taken into account for examining the novelty of the invention would not be everything made available to the public before the filing date of the subsequent application but everything made available to the public before the priority date, i.e. the date of filing of the original application. Thus, after filing the first application in Denmark, you are allowed to display and sell your product without affecting the right to file subsequent applications in other countries within 12 months of the original application. Several possibilities exist if you wish to file a subsequent application abroad. You can file a national patent application in each of the countries in question. However, you may also file a European patent application or a PCT application.
