DesignsIf your product or any parts thereof have a unique visual design that you wish to prevent others from copying, you need to register your design. Length of protection In Denmark and in most other countries the design registration must be renewed every 5 years. In connection with filing a design application, renewal fees are automatically paid for the first 5 years. It is possible to renew a design registration 4 times up to a maximum of 25 years. The maximum length of protection in different countries may vary. Novelty Certain requirements must be met in order to have your design registered. The design must be new and differ considerably from existing designs, i.e. it must have individual character. Thus, a design need not have artistic character in order to obtain protection. Please note that the design must not have been made available to the public prior to the filing date. However, if disclosure was made by the designer, there is a 'grace period' of 12 months allowing the designer to file a registered design application within 12 months of disclosure. |
